Within the context of global data privacy laws, we assume multiple roles concerning personal information held by Wiblion. It is important to distinguish between Wiblion Controlled PI and User Controlled PI to comprehend your rights and obligations.

“Wiblion Controlled PI” refers to personal information for which Wiblion determines the purpose and methods of processing. This Privacy Policy and the accompanying additional information solely address Wiblion Controlled PI.

“User Controlled PI” refers to personal information for which a User determines the purpose and methods of processing. In the case of User Controlled PI, Wiblion acts as a data processor, service provider, or a similar entity as defined by applicable law. User Controlled PI encompasses User Content and the personal information of End Users described in Section 12, which we host and process on behalf of our Users. We handle User Controlled PI based on the instructions provided by our Users, who are responsible for ensuring that their collection and processing of User Controlled PI complies with relevant legislation. 2. Personal information we collect

We gather various types of personal information related to you or your device. These may include:

  • Details provided by you when creating an Account, such as your email address, first name, and last name.
  • Information submitted when signing up for Paid Services, which typically includes your billing address and a portion of your payment information (e.g., the last four digits, country of issuance, and expiration date of the payment card). This information is shared with us by our payment processor.
  • Emails and other communications you send us or contribute, including customer support inquiries or posts on our customer message boards or forums. Please note that information shared on public sections of our websites is accessible to others.
  • Information you provide in relation to surveys, contests, or promotions.
  • Data collected from your usage of the Services or Users’ sites. This encompasses IP addresses, preferences, web pages visited prior to accessing our or our Users’ sites, details about your browser, network, or device (such as browser type and version, operating system, internet service provider, preference settings, unique device IDs, language, and regional settings), and information on how you interact with the Services and Users’ sites (e.g., timestamps, clicks, scrolling, browsing duration, searches, transactions, referral pages, load times, and any encountered issues like loading errors).
  • Information obtained from our partners to support our marketing initiatives, enhance our Services, and effectively monitor, manage, and measure our advertising campaigns. This may include data about instances where our ads are displayed by our partners on their advertising platforms.
  • Any other information you directly submit to us or provide through Third Party Services when using such services to create an Account. The collection of this information is subject to your privacy settings with the respective Third Party Service.

We acquire personal information from diverse sources, employing three primary methods:

  1. Directly provided by you: You supply certain information directly, for example, when you register for an Account.
  2. Automatically recorded during the use of our Services or Users’ sites: We automatically collect certain information when you interact with our Services or browse Users’ sites. This is done using technologies such as cookies.

a. Personal information you provide

Additionally, we retain your marketing preferences, as well as emails and other communications you send us, including customer support inquiries or contributions to our customer message boards or forums. On certain occasions, we may require specific information from you for contractual or legal purposes. For example, when registering or transferring a domain name via our Services, we collect your domain registration details to comply with ICANN, registry, ccTLD, or registrar policies.

This includes your IP address(es), device and browser type, the web page visited before accessing our sites, the duration and pages visited on our sites, and device identifiers. In our mobile apps, with your device settings permission, we may also collect location information.

If you are an End User of our Users’ sites, we gather information about your interactions with their sites. However, we handle this data in an anonymous, aggregated, or pseudonymized form that does not directly identify you. We utilize this information to assess, provide, protect, or enhance our Services, including the development of new products and services.

Certain aspects of this information are automatically collected using cookies and similar technologies when using our Services and Users’ sites. Except for cookies necessary for proper service provision (e.g., performance or security-related purposes), we allow our Users to control the use of cookies and similar technologies through their sites. c. Personal information obtained from other sources

When you use a Paid Service with us, we receive limited information about your payment card from our payment processor, Stripe. This includes the last four digits of your card, the country of issuance, and the expiration date. Stripe handles and processes your complete payment information in accordance with its privacy policy. We advise reviewing the privacy policy of the authorized payment processor for details on how they handle and process your payment information.

All direct payment gateways adhere to the PCI-DSS standard, managed by the PCI Security Standards Council, which consists of Visa, MasterCard, and American Express.

The requirements for PCI-DSS compliance help ensure the secure handling of credit card information.

Your data is encrypted during the payment process, ensuring that it remains secure and your payment is always processed safely.

4. How we use your personal information

We utilize the personal information we collect about you for the following purposes:

Provision of the Services: We create and manage your Account, personalize and provide our Services to you, facilitate domain name registration or transfer, process payments, and address any inquiries or requests you may have.

  • Communication with you: We communicate with you, including sending transactional emails and Service-related announcements to keep you informed.
  • Surveys and contests: We administer surveys, contests, and similar promotions for your participation.
  • Promotional activities: We promote our Services and deliver tailored marketing communications about products, services, offers, programs, and promotions from both Wiblion and our partners. Additionally, we assess the effectiveness of these campaigns. For instance, we may adjust the marketing communications based on your subscription plan or other information we have about you.
  • Advertising: We analyze your interactions with our Services and other online platforms to customize our advertising and deliver relevant content. For example, if you are already a subscriber to our Paid Services, we may exclude you from receiving advertisements on social media. Moreover, we may display specific advertisements based on your subscription plan or other relevant information.
  • Customizing the Services: We provide customized services to enhance your experience. This includes using your location information to determine language preferences and displaying accurate date and time information. We may employ cookies and similar technologies to achieve this goal, such as remembering your most recently edited sites.
  • Service improvement: We analyze and gather insights into how our Services are accessed and used. This helps us evaluate and enhance our offerings, develop new products and services, manage communications, and measure the effectiveness of our advertising efforts. In most cases, we utilize anonymous, pseudonymized, or aggregated information that does not directly identify you. For example, if we discover that a significant number of Paid Services users utilize a specific integration or feature, we may consider expanding upon it.
  • Security: We ensure the security and integrity of our Services to protect both you and our platform.
  • Third-party relationships: We manage relationships with our vendors and partners to support the provision of our Services.
  • Enforcement: We enforce our Terms of Service and other legal terms and policies.

  • Domain registration partners: If required by ICANN, registry, ccTLD, or registrar policies, we share your domain registration information with domain registration partners.
  • Payment processing: We transmit certain personal information through an encrypted connection to our payment processor for payment processing purposes.
  • Legal obligations and protection: We may disclose your personal information if we believe it is reasonably necessary to comply with the law, protect our or others’ rights, interests, or property (including enforcing our Terms of Service), or prevent fraud or abuse.   • Advertising: Personal information may be shared with third parties to provide you with tailored advertising and measure its effectiveness. For instance, we may share your pseudonymized email address with a social media platform to avoid displaying Wiblion ads to individuals who are already Wiblion users.
  • Business transfers: In the event of a reorganization, merger, acquisition, or sale of assets, your personal information may be transferred as part of the transaction or during the negotiation process.

  2. Marketing Communications: You can choose not to receive marketing communications by adjusting your preferences in your Account or following the unsubscribe instructions provided in the communications.
  3. Retention of Personal Information: Please note that deleting your personal information from our systems may involve a technical delay. We may also retain personal information as required by law, to protect our rights and the rights of others, to resolve disputes, or to enforce our legal terms or policies, to the extent permitted by applicable law.
  4. Restriction, Objection, and Data Portability: Under applicable law, you may have the right to restrict or object to the processing of your personal information or exercise a right to data portability.
  5. Lodging a Complaint: If you believe your rights under applicable data protection laws have been violated, you may have the right to lodge a complaint with a competent supervisory authority.
  6. Withdrawal of Consent: If we rely on your consent to process your personal information, you have the right to withdraw that consent at any time and at no cost. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

If you are an End User of a website hosted by one of our Users, you should directly contact the User to exercise your rights regarding any personal information they hold about you.

However, if you choose to delete your Account, we will delete the personal information we hold about you, unless we are required to retain it for legal or legitimate business purposes.
  6. Aggregated and Anonymous Information: We may retain aggregated, anonymized, or de-personalized information indefinitely. This type of information does not identify individuals and is used for statistical analysis, research, and other purposes.

Please note that even after your personal information is deleted, there may be residual copies or backups that remain in our systems for a certain period of time, but they will no longer be actively used or accessible.

10. Data transfer

We may transfer your personal information to countries other than the one in which you reside. For example, your information may be transferred to our servers in Netherlands. It’s important to note that the data protection laws in these countries may not be the same as the laws in your country.

To ensure the protection of your personal information during transfers, we rely on various mechanisms as required by the applicable data protection laws, including:

11. Privacy shield

Wiblion Group S.C.G.J. has certified its compliance with the Privacy Shield, which continues to apply.

Wiblion is committed to handling personal information received from the European Economic Area, Switzerland, and the United Kingdom in accordance with the applicable Privacy Shield Principles. Our certification can be found on the Privacy Shield website (https://www.privacyshield.gov).

We are accountable for the personal information we receive and subsequently transfer to third parties. If we engage third parties to process data on our behalf, we remain liable if they handle the data in a manner inconsistent with the Privacy Shield Principles unless we can prove that we are not responsible for the event leading to any damages.

12. End Users’ personal information

If you are a Wiblion user and have created a website using Wiblion, you are responsible for the personal information you collect from your end users. This section is specifically directed towards users in relation to their end users.

a. Your relationship with end users:

As a user, you will collect personal information from your end users. For example, when your end users fill a contact form, you may ask them to provide their name and email address to complete their submission. You may also use cookies and similar technologies to analyze usage and trends.

It is your sole responsibility to comply with applicable laws and regulations regarding the collection and use of personal information from your end users. This includes personal information collected from your end users through Wiblion functionality, cookies, or other technologies. Please note that you and Wiblion may be independent controllers of certain data (“Independently Controlled Data”). Independently Controlled Data includes data related to your end users’ interactions with your site, such as IP addresses, device/browser details, web pages visited prior to coming to your site, and browsing activity on your site. Independently Controlled Data may be collected by the Services through an end user’s browser and technologies like cookies. It’s important to note that Independently Controlled Data falls under both Wiblion Controlled PI and User Controlled PI.

You must create and publish your own privacy and cookie policies and ensure compliance with them.

Wiblion is not liable for your relationship with your end users or how you collect and use their personal information, even if you collect it through Wiblion functionality, cookies, or similar technologies. Wiblion does not provide legal advice on these matters.

b. End user payment information:

The payment information of your end users may be processed by third-party eCommerce Payment Processors with whom you integrate your Wiblion account, according to the terms and policies of those payment processors. We transmit your end users’ complete payment information to the eCommerce Payment Processors you have agreed to use only for the purpose of passing it along to them. Wiblion does not collect or store your end users’ payment information.

13. Majority of age

By using this website, you acknowledge that you are of the minimum legal age in the country or state in which you reside, or that, being of the minimum legal age in the country or state in which you reside, you have given consent to allow any minor under your care to use this website.

14. Updates to this Privacy Policy

We will update this Privacy Policy as necessary to reflect changes in technology, law, our business operations, or for any other reasons we deem necessary or appropriate. When we make changes, we will update the “Effective Date” at the top of the Privacy Policy and post it on our websites. If there are material changes to the policy or the way we process personal information, we will notify you.
