Domain contracting Policy

1. General Information

This Domain Name Registration Agreement (this “Agreement”) is entered into between Wiblion Group S.C.G.J, a cooperative company from Spain (“Wiblion”), and you, and becomes effective from the date of electronic acceptance.

This Agreement sets forth the terms and conditions of your use of Wiblion’s domain name registration services (the “Domain Name Registration Services” or the “Services”). The terms “we,” “us,” or “our” shall refer to Wiblion. The terms “you,” “your,” “User,” or “customer” shall refer to any person or entity accepting this Agreement. Unless otherwise specified, nothing in this Agreement shall be deemed to confer any rights or benefits on third parties.

Your electronic acceptance of this Agreement signifies that you have read, understood, acknowledged, and agreed to be bound by this Agreement, which incorporates by reference (i) Wiblion’s Terms and Conditions of Service Agreement, (ii) all agreements, guidelines, policies, practices, procedures, registration requirements, or operational standards of the top-level domain (“TLD”) in which you register any domain, and (iii) any plan limits, product disclaimers, or other restrictions presented to you on the homepage of the Domain Name Registration Services section of Wiblion’s website (this “Site”).

Notwithstanding anything to the contrary in this Agreement, the Domain Registry Operator in which the domain name registration is performed is and shall be an intended third-party beneficiary of this Agreement. As such, the parties to this agreement acknowledge and agree that the third-party beneficiary rights of the Registry Operator have been conferred and that the Registry Operator has relied upon its third-party beneficiary rights under this Agreement by accepting that Wiblion, shall be the default intermediator of domain registrations, for all domains registered through Wiblion. The third-party beneficiary rights of the Registry Operator shall survive the termination of this Agreement.

2. Domain Registration Requirements

To the extent that any TLD or ccTLD requires you to comply with requirements (e.g., residency for .JP, .EU, etc.), validation (e.g., DNS validation), or other authentication requirements as a condition for registering a domain name in the TLD, you agree that by submitting an application or registering or renewing your domain name, you represent and warrant that:

(a) all information provided for registering or renewing the domain name (including any supporting documents, if applicable) is true, complete, and accurate, and is not misleading in any way, and the application is made in good faith;

(b) you comply, and will continue to comply, with the eligibility criteria prescribed in the Registration Policies for the applicable TLD during the duration of the domain name registration;

(c) you acknowledge and agree that even if the domain name is accepted for registration, your right to register the domain name may be challenged by others claiming entitlement to such domain name; and

(d) you acknowledge and agree that the Registry or the registrar may cancel the domain name registration if any of the required warranties are false, incomplete, incorrect, or misleading.

3. Domain Ownership

You acknowledge and agree that the registration of a domain name does not create any ownership rights for you or for Wiblion in terms of the ICANN, the registrar, or any other person in the name used as the domain name or the registration of the domain name, and that the entry of a domain name in the Registry shall not be construed as evidence of ownership of the registered domain name. You shall not transfer or purport to transfer ownership in any domain name registration or grant or purport to grant as security or otherwise encumber or purport to encumber a domain name registration.

4. ICANN Requirements

You agree to comply with the requirements, standards, policies, procedures, and practices of ICANN for which each applicable Registry Operator has the responsibility to monitor under the Registry Agreement between ICANN and itself or any other agreement with ICANN. 5. Attributable and Non-Uniform Prices

You acknowledge, understand, and agree that certain domains with certain TLDs have a variable price (i.e., standard names vs. premium names) and/or may have a non-uniform registration renewal fee (so that the fee for renewing the registration of a domain name may differ from other domain names in the same TLD).

6. Responsibility for Domain Registration

When you purchase a domain through Wiblion, it is your responsibility as the user or customer to ensure the availability of the domain. Wiblion provides a domain search tool and encourages you to use it or any other tool that can provide you with such information. Wiblion will not be held responsible for the unavailability of a domain ordered from the moment the order is placed until the domain is intended to be registered with the default domain registrar.

7. Exemption From Action Domains

Wiblion does not deal with domains intended for auction or domains that are not initially available. Thus, Wiblion reserves the right to work with domains that may need to be repurchased from other users or bid upon for acquisition.

8. Limitation of Registry with Specific TLDs

When purchasing a domain through Wiblion, you are limited to the designated top-level domains (TLDs) or extensions available during the purchase process. Wiblion reserves the right to expand its support for other types of TLDs or extensions in the future. This means that the list of supported TLDs or extensions may change and be modified over time, allowing users to register domains with different characteristics.

9. Fees and Payments

9.1. General terms, including auto-renewal terms

You agree to pay all prices and fees due for the Services purchased or obtained on Wiblion at the time you request the Services. Wiblion expressly reserves the right to change or modify its prices and fees at any time, and such changes or modifications will be posted online on this Site and will take effect immediately without the need for further notice to you. If you have purchased or obtained the Services for a period of months or years, changes or modifications to prices and fees will be effective upon renewal of the respective Services as described below.

9.2. Domain name renewal terms

When you register a domain name, you will have the following renewal options:

When you register a new domain name, it will be automatically renewed for a period equivalent to the duration of your original domain name registration, which by default is one (1) year from the date it was registered. Any domain name that is up for renewal will be automatically renewed and the payment will be processed using the default Payment Method you have established in your Wiblion account. Therefore, if you have chosen to register your domain name for one (1) year, Wiblion will automatically renew it for one (1) year.

All renewals will be subject to the terms of this Agreement, as it may be amended from time to time, and you acknowledge and agree to be bound by the terms of this Agreement (as amended) for all renewed domains. Domain name renewals are non-refundable. In the event that we are unable to automatically renew your domain name for the selected renewal option for any reason, we may automatically cancel or downgrade your domain name in a grace period of within thirty (30) days, unless during that period you make the necssary adjustements to pay for it.

9.3. Domain name transfer terms

When you transfer a domain to Wiblion, our domain contracting policy will be applied. As part of this policy, the domain you wish to transfer will be automatically contracted for its purchase price to ensure that you become the rightful owner of the domain upon successful transfer to Wiblion. Once a domain transfer has been initiated, it cannot be reversed. We strongly advise reviewing all transfer details carefully before proceeding with the transfer process or contact our support team for more information.

After the domain transfer to Wiblion is completed, the domain will be automatically set for future renewal on the same day as the transfer. To ensure continuous ownership of the domain and protect your rights, Wiblion will automatically renew the domain for a period equivalent to the duration of your original domain transfer. By default, the original registration period is set to one (1) year from the date the domain was transferred to our platform.

10. Refunds

Wiblion does not provide refunds for the payment made for acquiring a domain. The amount paid for the domain is non-refundable, as per the default policy of the domain registrar used by our company. In the event that you need to cancel a domain to avoid future charges, you can do so through your Wiblion customer account.

Additionally, please be aware that domain transfers are also non-refundable, having in account that the transfer performs succesfully. In the event that the transfer is not successfully done to the Wiblion platform because of internal causes within the company, Wiblion will refund the pre-paid amount that was done when requesting the transfer.

11. Duration of the Agreement

The term of this Agreement shall remain in full force and effect as long as you have any domain name registered through Wiblion.

12. Domain Transfer Conditions

By using Wiblion’s domain registration services, you agree not to transfer any domain name to another domain name registrar within the first sixty (60) days following its initial registration date. Additionally, you agree not to transfer any domain name within ten (10) days after an Account Change. These restrictions are in place due to the limitations imposed by the default domain registrar utilized by Wiblion for domain registrations.

13. Domain cancellations

When canceling your domain, it’s important to follow the necessary steps to ensure a smooth process. Here are some important details to keep in mind:

To cancel your domain successfully, it is crucial to initiate the cancellation process at least 48 hours before the start of the next billing period. This allows our system enough time to process your request and prevent any charges for domain renewal. You can cancel your domain directly from the Wiblion account.

Fail to initiate the cancellation within the specified 48-hour window, the domain renewal may still be charged to your account, even if your intention was to cancel. We recommend planning ahead and considering the timing of your cancellation to align with the billing cycle. By doing so, you can avoid any unexpected charges and effectively manage your domain subscriptions.

14. Modifications

We may make modifications to this Policy, and the most current version will be posted on our website. If a modification significantly reduces your rights or includes great changes, we will notify you through means such as email or prominent notice. The notice will specify a reasonable period after which the new terms will take effect. Modifications will not apply retroactively. By continuing to use or access the Services after the effective date of any modifications, you agree to be bound by the modified Agreement and any associated price changes. If you disagree with the changes, you must cease using the Services and cancel any Paid Services.
